1. Introduction

The following TERMS OF SERVICE AGREEMENT ("Agreement") describes the conditions for using LDSdates.com's services ("Services") which are provided by LDSdates.com and other parties (collectively referred to hereafter as "LDSdates.com" or "we"). This document constitutes a binding agreement between LDSdates.com and the LDSdates.com Member ("Member" or "you"). The Agreement must be accepted prior to usage of the Services requested by registering. By using the Services, you agree to be bound by the terms and conditions set forth below.

You must meet the following requirements to use this site. You must be a member of The Church of Jesus Christ of Latter-day Saints. You must be at least 16 years of age. You must be legally single. You must provide only current, truthful, and accurate information to LDSdates.com and other registrants. You cannot put any contact information in your profile, including e-mail addresses, telephone numbers, street addresses, or websites containing such information. You cannot put hyperlinks anywhere in your profile. You cannot promote any type of business, product, or service. You cannot use inappropriate language. You cannot send chain or other forms of junk mail. You agree that LDSdates.com is not responsible for the actions of its members. You agree to indemnify and hold harmless LDSdates.com, all owners, employees, officers, and all third parties in the event of any and all damages arising from your membership in and usage of LDSdates.com. No refunds will be granted for unused time or canceled accounts. You agree to pay all court costs and reasonable attorney fees incurred by LDSdates.com necessary to enforce its rights under this agreement. Any reproduction, duplication, distribution, or transmission without the prior written consent of LDSdates.com is prohibited. You grant LDSdates.com all usage rights for material submitted to LDSdates.com. You will only use LDSdates.com's services for lawful purposes. You will not provide information or access to any material which LDSdates.com, in its sole discretion, may consider illegal, offensive or improper.

LDSdates.com reserves the right to edit, reject, or remove photos and/or text which, in the sole judgement of LDSdates.com, is inappropriate. LDSdates.com has the right to edit your profile to bring it into compliance with the terms of this Agreement. LDSdates.com has the right to remove any member account without notification. The contents of the LDSdates.com web site are the property of LDSdates.com. LDSdates.com provides this service on an "as-is" basis without warranty, either expressed or implied. LDSdates.com may revise this Agreement at any time without notification. Your continued use of the services provided by LDSdates.com constitutes acceptance of the revised Agreement.

2. Fees and Payment

You shall pay the fees and other charges required for each Service associated with LDSdates.com. All fees are non-refundable. LDSdates.com reserves the right to change rates and may notify Members with a message in an obvious location on the site. You shall make all payments in U.S. currency. LDSdates.com reserves the right to suspend or terminate your account if charges are denied. Suspension or termination shall not relieve you of the obligation to pay the outstanding fees. LDSdates.com charges .00 for every returned check and for every charge back.

3. Term and Termination

LDSdates.com reserves the right to terminate this Agreement and Member's account for any violation of this agreement or the provisions of LDSdates.com's Privacy Policy as determined by LDSdates.com sole discretion. LDSdates.com reserves the right to delete any account it deems unacceptable for any reason without prior notice. LDSdates.com shall have no obligation to refund any of Member's fees on terminated accounts.

You may terminate the Services at any time by making the appropriate selections on the Update Profile Area of your account. If you or LDSdates.com terminates your account before your paid account is expired, LDSdates.com has no obligation to refund your fees for the unused account time.

LDSdates.com reserves the right to remove member accounts for inactivity, failure to activate an account or for lack of profile data. LDSdates.com has no obligation to refund your fees for the unused portion.

4. Responsibility for Member Profile Development, and Maintenance.

Member will assume total resposibility for the content, development, and maintenance of Member's Profile, i.e., all content appearing online or on Member's profile, including without limitation: the accuracy and appropriateness of content ensuring that the content appearing within the profile does not violate or infringe upon the rights of any third party; ensuring that the content appearing within the profile is not libelous or otherwise illegal;

The opinions and views expressed in the LDSdates.comed Web pages do not necessarily reflect those of LDSdates.com. Some contents of the Member pages on LDSdates.com may not be reviewed in any way before they appear on the Site. LDSdates.com reserves the right to terminate your LDSdates.com account and remove any profile it determines, in its sole judgment, is in violation of any provision of this Agreement.

5. Registration E-mail

LDSdates.com reserves the right to require submission of an e-mail address from its members.

6. Member Communication

LDSdates.com reserves the right to send Members service and notification e-mails notifying the Member of changes that may affect the services offered. LDSdates.com also reserves the right to communicate with its Members regarding, but not limited to, account status, special promotions, and new services .

7. Amendments/Modifications

LDSdates.com reserves the right to amend the Services offered and add, delete, suspend or modify the terms and conditions of the Services set forth in this Agreement, at any time, and to determine whether and when, at its sole discretion, any such changes apply to both existing or future Members.

8. Security

It is illegal to attempt to compromise the security on the LDSdates.com by any means. LDSdates.com reserves the right to prosecute any individual attempting to compromise the security of the LDSdates.com servers to the fullest extent allowable by federal, state or local law.

9. Disclaimer of Warranties

The member understands that the Internet and other various networking communication mediums are not secure, and may be subject to interception or loss. LDSdates.com makes no warranties of any kind, either express, implied or statutory, concerning the data or information available through LDSdates.com or the Internet. LDSdates.com SERVICES ARE PROVIDED ON AN "AS IS" BASIS. LDSdates.com MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LDSdates.com DISCLAIMS ANY AND ALL WARRANTIES.

10. Limitation of Liabilities

IN NO EVENT SHALL LDSdates.com BE LIABLE FOR DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, THE HOSTING SERVICES, OR THE INABILITY TO USE THE HOSTED SITE. LDSdates.com's has no liability to the Member for damages for any cause whatsoever, regardless of the form of damage.

This agreement is entered into in the State of Utah and shall be governed by the laws of the State of Utah. LDSdates.com, ITS OFFICERS, DIRECTORS, OWNERS, AGENTS AND EMPLOYEES, SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY RESULTING FROM THE USE OF THE HOSTING SERVICES, CAUSED IN WHOLE OR IN PART BY ITS NEGLIGENCE OR CONTINGENCIES BEYOND ITS CONTROL IN PROCURING, COMPILING, INTERPRETING, REPORTING, MAINTAINING OR DELIVERING THE SERVICES. LDSdates.com, ITS OFFICERS, DIRECTORS, OWNERS, AGENTS AND EMPLOYEES, SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, OR SIMILAR DAMAGES, EVEN IF ADVISED OF THE POSSIBLILTY OF SUCH DAMAGES, RESULTING FROM THE USE OR INABILITY TO USE THE SERVICES.

11. Privacy

LDSdates.com may maintain information about members, including but not limited to Member's account registration information and sales information . Member agrees that LDSdates.com may use Member Information in a manner not attributable to the Member for marketing purposes.

Member agrees that LDSdates.com may disclose Member Information to comply with the legal process, to enforce the Agreement, and to respond to violations of the rights or interests of LDSdates.com or third parties.

Member shall maintain a password to access and use the services. Member is entirely responsible for any and all activities that occur under Member's account and password. Member agrees to keep passwords confidential, to allow no other person or company to use their account, and to notify LDSdates.com promptly if Member has any reason to believe that the security of said account has been compromised.

12. Miscellaneous

This Agreement supersedes and replaces any written or oral agreements between LDSdates.com and Member. Any failures by LDSdates.com to enforce any provision of this Agreement shall not constitute a waiver of any term hereof.

The unenforceability of any provision in a given jurisdiction shall not render that provision unenforceable in any other jurisdiction. All provisions are independently enforcible by LDSdates.com.

The section titles in this Agreement are for convenience only, and have no legal or contractual effect.

LDSdates.com shall not be liable for nonperformance, delay, errors, data loss or other loss caused by any event including, but not limited to acts of God, war, hostilities, revolution, civil disorder, national emergency, strikes, lockouts, unavailability of supplies, epidemics, fire, flood, earthquake, force of nature, explosion, embargo or any law, proclamation, regulation, ordinance or other act or order of any court, government or governmental agency LDSdates.com is not affiliated with The Church of Jesus Christ of Latter-day Saints.

LDSDATES.COM DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. USERS OF THE SERVICES PROVIDED BY LDSDATES.COM USE THE SERVICE AT THEIR OWN RISK.
